Six states (Arkansas, Arizona, Illinois, Indiana, Minnesota, and Washington State) allow debt collectors to seek arrest warrants for debtors in default if all other collection methods have failed. Whether a debtor will actually be prosecuted or not varies from state to state, county to county, and town to town. The individual is taken into custody and is typically required to submit financial documentation to the courts (to facilitate seizure of assets or wage garnishment), although in some cases the individual may be held indefinitely until a payment plan is reached or the debt is paid in full, especially if the individual is insolvent.[8] Other states have outlawed this type of collection action (Tennessee and Oklahoma have ruled it unconstitutional).[9] unless the court finds that the debtor actually possesses the means to pay--except in the case of child support obligations.[10][11][12]

A Lot of Talk But No Action

I'm sure some of you have been contacted by Mark Guest to "make good" on the money he has swindled from folks.
Well, I received a call from him back in May to provide me with his assurance that he will pay me back every last penny. Interestingly enough this coincided with him about to be hired to work on a new venture out of Henderson, NV and the management wanted to make sure he would clear his name with all of us before any finalization..
Here is his text message to me back in May 2010:
"it was never my intent for things to go wrong with my biz plus have such a difficult time in the work place but if given the opportunity im now there to make things happen fr both u and i. I want to make it right...It is my immediate desire to prove to u my sincerity"
My message in July 2010:
"Let me know if you will start the payback soon."
Mark:
"Hi oh damn A"
"Im sorry"
"Let me call u when I break. I'm at a seminar! Yes I have to get u some cash my bad"
August 2010:
"When are you going to make a deposit?"
Mark:
"Yes I'm awaiting my check so I will before weeks end"
"The bank didn't cash my check sd I don't have a Nevada ID as of yet! I'm getting you your money today if I can sign over my check..."

YEAH, RIGHT, ASSHOLE!!!

here is an e-mail I received from an anonymous "concerned" friend:

Sadly to say, Mark con man Guest has struck again...He has used and abused my sweet friend for the past year. She finaly had enough of him, and kicked him out a few months ago..He drained her credit cards w cash advances up to $26,000 dollars. He lived rent free and had her chauffure his adorable daughter around...He NEVER left the couch and promised her a wonderful life in which he was going to marry her and have more children....Stay away from this person ( he is a con man)

Open Letter to Mark Guest:

Some more people are looking for you in addition to me. More people you have scammed -- either borrowed money from and skipped town or outright stolen from.

They will be finding you and your day will finally come to make good on your promises. Wouldn't it feel good to repay your "friends" back? All those people who trusted you, who felt bad that you were behind in your child support payments?

Watch out -- you will need to start paying us all back. No more living the "high" life for you and your ex wife, no more $100 tips for 2 drinks to your favorite cocktail waitress, no more excess, no more expensive dinners.

By the way, do you also know you are wanted for bank fraud and tax evasion?

Mark Gone Underground

Since October, Mark has gone underground. He had promised to pay me back and my credit will be in the 400's for the next decade due to his dishonesty and theft. I don't understand why the police do not prosecute white collar crime, but this is one criminal that should be caught before he does the same to someone else.

If ANYONE has any information about Mark, please respond to this posting. There are a lot of people that he has scammed besides me in Southern California.

The Scam

Mark Sean Guest came to me a couple of years ago and aksed me to help with his new company Kasper, Ltd. He wanted me to work for him. I knew Mark during the time he lived in Chicago 17 years ago. We kept in touch on and off over the years.

I thought it would be an interesting opportunity to work on some new projects. He issued me an American Express card, Discover card, and an Advanta business card. He encouraged me to use them. So, since I was going to do some work for him in Chicago, I bought a laptop.

Last Summer, he stopped paying his credit cards.

In August I found out he used my identity to apply for these cards. I was getting calls from a collection agency stating that I was responsible and that it appears on my credit report.

That month prior, my husband and I found out I was pregnant after a year of trying. The previous Summer I suffered a miscarriage, so the stress of receiving this news was even more upsetting.

The overdue amount on AMEX was (and still is) $35,000.

The overdue amount on Advanta was $15,000.

The overdue amount on Discover was $6,000.

He promised that he would pay, but encouraged me to deal with the credit card companies because they were in my name. I agreed to pay Discover in full using the savings account I started for my baby, and I set up a payment plan for Advanta because Mark assured me he would send me the money to cover it.

I have received about $1500 from him since he made these promises in October 2008. He promised me regular bi-weekly payments of at least $750, but it never materialized.

I refuse to pay AMEX. They have since placed a "charge off" note on my credit report. This week, I checked into a hotel for a biz trip, and my credit card was denied. My credit limit is $15,000 and it was reduced to $500.

He has totally f#*%d my finances, my credit, and my ability to provide for my new baby. -- Yes, we had a healthy baby boy in March.

I am posting this blog as a warning to all. He will be looking for a new victim to finance his life (and his self-destructive habits).
